Question:
În temeiul art. 37 alin. (9) din Legea nr. 131/2015 privind achizițiile publice, specificațiile tehnice trebuie să permită accesul egal al ofertanților și să nu creeze obstacole nejustificate care restrâng concurența.
În acest context, gruparea produselor într-un singur lot poate fi problematică dacă:
- produsele aparțin unor categorii comerciale diferite, iar furnizorii sunt specializați doar pe anumite categorii;
- operatorii economici care comercializează conserve de carne nu comercializează neapărat marinate, legume conservate de diferite tipuri;
- participarea la procedură respectivă presupune obligația de a oferta toate categoriile de produse, excluzând operatorii care ar putea oferi prețuri competitive doar pentru anumite produse;
- divizarea în loturi distincte ar permite participarea unui număr mai mare de operatori economici și ar favoriza concurența.
