Question:
Stimată Autoritate Contractantă,
Vă rugăm să reanalizați specificațiile tehnice din caietul de sarcini, deoarece unele caracteristici sunt indicate prin valori fixe (de exemplu: tensiune 21 V, energie de impact 2,5 J, turație, număr de percuții, diametre maxime etc.), ceea ce poate restrânge concurența și poate favoriza un anumit model sau producător.
În conformitate cu principiile concurenței loiale și tratamentului egal prevăzute de legislația privind achizițiile publice, considerăm oportun ca specificațiile să fie formulate prin cerințe minime sau intervale de performanță

Buna ziua,
Autoritatea Contractantă a analizat solicitarea dumneavoastră privind revizuirea specificațiilor tehnice din caietul de sarcini.
Precizăm că specificațiile tehnice au fost elaborate în conformitate cu necesitățile reale ale Autorității Contractante și nu fac trimitere la un anumit brand, producător sau model de produs. Caracteristicile tehnice solicitate reprezintă cerințele minime necesare pentru asigurarea funcționalității și performanței echipamentelor în activitatea instituției.
Totodată, menționăm că pe piață există mai mulți producători și mai multe modele de echipamente care îndeplinesc aceste caracteristici tehnice, astfel încât cerințele stabilite nu limitează concurența și nu favorizează un anumit operator economic.
În consecință, Autoritatea Contractantă consideră că specificațiile tehnice sunt justificate de necesitățile instituției și respectă principiile tratamentului egal, nediscriminării și asigurării concurenței prevăzute de legislația în domeniul achizițiilor publice.
Prin urmare, documentația de atribuire rămâne nemodificată, iar specificațiile tehnice vor fi menținute în forma publicată.
