Question:
I. Regarding the documents/information to be provided by a subcontractor:
1. Based on the listed requirements, it can be concluded that a subcontractor should provide a separate document covering items 3–7 of the “D. Tender Form for a Supply Contract” template, as well as the Declaration of honor. Could you please confirm whether the subcontractor is also required to submit:
a. financial statements/reports supporting Item 3; and
b. reference contract(s) supporting Item 6? or
c. any other documents
2. Please clarify how the “7. Tenderer’s Declaration(s)” should be completed by a subcontractor, as some statements do not appear applicable to an entity providing only specific services or a limited portion of the scope rather than delivering an entire lot. Example: points 2–4, 6, partially point 8 (“We are making this tender in our own right”), and point 10 (“We confirm that we, including all consortium members, if any, and subcontractors, are not included in the EU restrictive measures lists.”). Is it permissible to amend or redact the declaration to reflect the subcontractor’s role, or is there a separate template intended for subcontractors?
3. Is the subcontractor also expected to provide the Legal Entity File (Form G5) and the Financial Identification Form (Form G4), as referenced in point 7 of the “Tenderer’s Declaration(s)”? Alternatively, should this requirement be adjusted for the declaration submitted by a subcontractor?
II. The current wording on the p. 1.3 from “Draft contract” and 6.2 of the “Special conditions” states that the Implementation Phase may last up to 7 months from contract start, while the Exploitation Phase should begin no later than month 7. This wording suggests a potential overlap between the two phases. If this is not the intention, the recommendation would be to review the wording

I. Regarding the documents/information to be provided by a subcontractor:
1. A subcontractor must submit financial statements (D1 pt.3) and reference contracts (D1 pt.6) only if its capacity is relied upon by the tenderer to meet a selection criterion (i.e., it acts as a capacity-providing entity per D1 footnote [2] and the "Capacity-providing entities" section). In that case the data is submitted as a separate document, with evidence provided on request.
2. The same Tenderer's Declaration template (D1 pt.7) is used by subcontractors — there is no separate template. Points describing the scope of the tender (pt.2) and the tendering capacity (pt.8) should be adapted to reflect that the entity signs as subcontractor for the specific goos/services it will perform, not the full Lot. Exclusion/integrity points (9, 10, 11, 13, 14) must be completed in full, without redaction, as required by A2 §3.1.
3. D1 point 7 literally states, within the declaration text used by every signatory including subcontractors: "We attach the legal entity file (form G5) and the financial identification form (form G4)." Read literally, and without supplementing the text with an unstated exception, this clause currently requires every signatory of point 7, including subcontractors, to attach both forms.
II. Faza de Implementare/Exploatare:
Cele două condiții din B1/B2 sunt secvențiale, nu suprapuse: Faza de Exploatare începe doar după validarea formală a Fazei de Implementare finalizate, iar acest început nu poate depăși luna 7. Deoarece Faza de Implementare este limitată tot la 7 luni, ambele condiții converg către același plafon. Nu este prevăzută derularea simultană a celor două faze.

- On the Tenderer's Declaration template (D1 pt.7) to be signed by the sub-contractor:
o Is it expected points 3 & 4 should be completed? Or they will remain blank?
o How do we interpret point 6 in a declaration signed by a sub-contractor? Is this point to be excluded?
Answer (22 Jun 2026, 10:00):
Sub-points 3 (price), 4 (discount) and 6 (performance guarantee) of point 7 of the Tenderer's Declaration (D1) concern the financial/contractual offer submitted to the Contracting Authority, an obligation assumed solely by the tenderer, not the sub-contractor; accordingly, these sub-points do not apply to the sub-contractor and should be explicitly marked "Not applicable" rather than left blank, to avoid being read as an omission during the administrative compliance review.
