Buna ziua! Vă rugăm sa divizați lotul 1 - Produse alimentare pentru colete in poziții aparte, pentru a oferi mai multor agenții economici posibilitatea de participare. Dar în așa condiții veți limita alți concurenți să participe la licitația data. Nu creați impedimente, încălcând totodată Legea concurenței nr. 183 din 11.04.2012 prevederile art.12 alin (2) lit. b). Mulțumim anticipat!

Conform prevederilor Legii nr. 131/2015 privind achizițiile publice, autoritățile contractante sunt cele care decid asupra structurării achiziției în loturi, în funcție de natura, complexitatea și specificul obiectului achiziției. Legea prevede în mod expres că autoritatea contractantă are dreptul și obligația, atunci când este cazul, să împartă contractul pe loturi pentru a asigura accesul IMM-urilor și pentru a eficientiza utilizarea fondurilor publice. Această decizie aparține exclusiv autorității contractante, ținând cont de analiza necesităților și de strategia de achiziții.”
În ceea ce privește invocarea art. 12 alin. (2) lit. b) din Legea concurenței nr. 183 din 11.07.2012, considerăm că structura actuală a lotului nu creează o barieră nejustificată în calea concurenței și nu are drept efect eliminarea unor operatori de pe piață. Această formulare respectă principiile proporționalității și transparenței, fiind justificată de natura și volumul achiziției.
