Buna! Insistăm divizarea produselor din origine animala si a peste in loturi aparte. Bunurile acestia adunate intr-un lot nu au legatura stringenta intre ele si nu se folosesc impreuna, mai mult ca atit sint produse de diferite producatori. Oricare agent economic nu poate să aibă in portifoliul sau toate produsele solicitate si din aceasta cauza pierde nejustificat posibilitatea de a participa la licitatia in cauza. Nu creați impedimente, încălcând totodată Legea concurenței nr. 183 din 11.04.2012 prevederile art.12. Dacă nu le divizați vom fi nevoiți să contestăm.
Answer (15 Dec 2025, 11:08):
Dorim să menționăm că decizia grupului de lucru privind structura loturilor nu s-a axat în niciun fel pe restrângerea, împiedicarea sau denaturarea concurenței, ci a avut în vedere exclusiv criterii logistice și funcționale privind buna desfășurare a procedurii de achiziție.
Nu a existat intenția de a limita drepturile de a comercializa produse, de a stabili condiții discriminatorii sau de a acorda privilegii.
În acest context, considerăm că nu sunt întrunite condițiile care ar duce la încălcarea prevederilor Legii concurenței nr. 183 din 11.07.2012, întrucât structura loturilor propusă nu elimină și nu restrânge în mod nejustificat accesul operatorilor economici, ci permite participarea în mod echitabil, în funcție de specificul fiecărui ofertant.
