Această procedură se aplică bunurilor, nu lucrărilor
Question:
În documentație este indicat CPV 37535200-9 – echipamente pentru locuri de joacă, care aparține categoriei de bunuri, însă denumirea procedurii „Amenajarea unui teren de joacă” și template-ul utilizat sunt specifice lucrărilor.
Totodată, caietul de sarcini prevede exclusiv echipamente și montarea acestora, fără lucrări de construcție sau amenajare care ar justifica încadrarea procedurii ca „lucrări”.
Menționăm că această clasificare este incorectă.
Conform obiectului real al achiziției și CPV-ului indicat, procedura trebuie încadrată corect la bunuri cu servicii de instalare, și nu la lucrări.
Solicităm rectificarea clasificării procedurii, astfel încât documentația de atribuire să reflecte în mod corect natura achiziției și să fie în conformitate cu legislația aplicabilă.

p. 20 din ANUNȚ DE PARTICIPARE (mostre la solicitare)
Question:
În punctul 20 din ANUNȚ DE PARTICIPARE este indicată obligația de a prezenta mostre în termen de 3 zile de la solicitare. Solicităm eliminarea acestui punct, deoarece participantul la procedură nu este obligat să dețină pe stoc produse nestandardizate, solicitate de autoritatea contractantă, cu atât mai mult în valoare de aproximativ 290 000 lei.
Un asemenea criteriu poate avea un caracter selectiv și poate crea premise pentru excluderea nejustificată a unor participanți. Se ridică întrebarea dacă nu există deja un operator economic favorizat, care dispune în prezent de aceste produse pe stoc.
Solicităm respectuos revizuirea și eliminarea acestui punct, pentru a exclude riscurile de discriminare și pentru a asigura acces egal tuturor participanților la procedură.
