Solicitare clarificare privind specificațiile tehnice din caietul de sarcini
Question:
Referitor la caietul de sarcini aferent procedurii de achiziție publică, dorim să solicităm clarificări suplimentare privind formularea specificațiilor tehnice incluse. Am constatat că în Caietul de sarcini sunt menționate produse/echipamente/servicii, fără a include sintagma „sau echivalentul”, astfel existând riscul de a favoriza un anumit producător sau operator economic. Conform articolului 37, alin. (6) din Legea 131/2015 privind achizițiile publice, „Specificatiile tehnice nu vor face referire la o anumită marcă comercială sau la un anumit agent economic (…) În cazul în care nu există un mod suficient de exact de expunere a cerințelor față de achiziție, iar o astfel de referință este inevitabilă, caracteristicile vor include cuvintele ‘sau echivalentul’.” Având în vedere prevederile legale menționate, vă rugăm să ne clarificați dacă cerința din caietul de sarcini va fi actualizată pentru a respecta principiile de nediscriminare, tratament egal și concurență, prin adăugarea sintagmei „sau echivalentul” acolo unde este cazul.

Buna ziua. Pentru a putea participa cit mai multi ofertanti, se acceptă participarea și a produselor alternative/echivalentul, cu condiția ca acestea să respecte cerințele tehnice specificate.
