Clarificare
Question:
Menționăm că referirea exclusivă la Directivele 93/42/CEE și 2007/47/CE nu este conformă cu cadrul legislativ actual. Începând cu mai 2021, dispozitivele medicale sunt reglementate prin Regulamentul (UE) 2017/745 (MDR). Totuși, în baza art. 120 din MDR, certificatele emise sub Directiva 93/42/CEE rămân valabile pe perioada de tranziție și permit punerea pe piață a produselor până în anii 2027/2028. Solicităm clarificarea documentației astfel încât să fie acceptate dispozitivele conforme MDR, precum și cele aflate legal pe piață în perioada de tranziție conform art. 120 MDR.
Totodată, solicităm clarificarea următoarelor aspecte tehnice:
• să se clarifice dacă banda adezivă este prevăzută exclusiv în jurul orificiului sau dacă se solicită o folie de incizie care să acopere întreaga zonă de incizie.
• să se clarifice dacă orificiul de incizie este prevăzut sub forma unui cerc cu diametrul de 10 cm sau a unui pătrat de 10 × 10 cm;
Menționăm că specificația referitoare la „zonă absorbantă pe toată suprafața inciziei” este neclară și contradictorie cu practica medicală. În mod uzual, zona de incizie este acoperită cu folie de incizie impermeabilă și autoadezivă, iar zonele absorbante și ranforsate sunt prevăzute în jurul acesteia. Solicităm clarificarea dacă se dorește ranforsare suplimentara în jurul inciziei (mentionand materialul si dimensiunea, daca este cazul) sau folie de incizie impermeabilă pe zona inciziei propriu-zise, conform standardelor EN 13795-1.

Bună ziua, pentru lotul respectiv, au fost indicate cerințele minime, în baza cărora o să fie evaluate ofertele operatorilor economici. Toate ofertele o să fie evaluate și după caz, o să fie solicitate mostre pentru a clarifica caracteristicile tehnice. De asemenea, reiterăm faptul că prezentarea ofertelor îmbunătățite, este apreciată și considerată oportună de către grupul de lucru. Vă mulțumim pentru clarificare.
