Care este modalitatea corectă de constituire a garanției pentru ofertă, avînd în vedere că, potrivit pct. 16, poziția 6 din Anunțul de participare, Autoritatea Contractantă solicită o scrisoare de garanție bancară de 1%, iar conform pct. 17, garanția pentru ofertă poate fi constituită prin transfer la contul AC?
Answer (31 Jan 2025, 11:08):
Potrivit pct. 126 din HG Nr.638 din 20.02.2020 garantia pentru oferta este constituita prin scrisoare de garantie bancara sau prin transfer pe contul autoritatii contractante. In Anuntul de participare sau indicat in pct.17 datele bancare a AC pentru OE care vor transfera garantia pentru oferta prin transfer pe contul AC. Ambele modalitati se vor considera corect.
