Organism neinregistrat in Republica Moldova
Question:
Buna ziua,
1.Un organism de certificare care nu are sediul in Republica Moldova, poate trimite factura semnata electronic prin email, in cazul in care ar fi declarat castigator?
2. Poate fi aceasta factura emisa si platita in EURO/USD intrucat nu avem cont in MDL?
3. Plata garantiei de participare se poate face si in alt cont decat cel de MDL? Am prefera un cont de EURO/USD sau RON.

Organismul de certificare care nu are sediul în Republica Moldova și are intenția să participe la această procedură de achiziție trebuie să pregătească oferta în conformitate cu cerințele publicate în Documentația de atribuire publicată. Respectiv, oferta trebuie depusă și indicată pe platformă electronică SIA RSAP (MTender) în MDL deoarece platforma electronică nu permite să fie indicată altă valută (EURO/USD/RON).
În cazul depunerii ofertei electronice în EURO sau USD, pe SIA RSAP se va indica oferta în MDL conform ratei oficiale de schimb EURO/MDL sau USD/MDL stabilită de Banca Națională a Moldovei la data depunerii ofertei. Pentru evaluarea și compararea ofertelor depuse în valute diferite se va aplica rata oficială de schimb EURO/MDL sau USD/MDL stabilită de Banca Națională a Moldovei la data deschiderii ofertelor.
1. Invoice-ul/Factura poate fi transmisă prin email în cazul unui nerezident.
2. Invoice-ul/Factura poate fi emisă în EURO sau USD, dar se acceptă doar cu semnătura olografă, din cauza lipsei mecanismului de verificare a semnăturii electronice emise în afara RM.
În scopul aplicării prevederilor tratatelor internaționale privind evitarea dublei impuneri cu nerezidenții, Furnizorul va prezenta „Certificat de rezidenţă” eliberat de autoritatea competentă din statul său de rezidenţă, în caz contrar autoritatea contractantă va reține impozitul pe venit în mărime de 12% din plățile direcționate spre achitare, conform prevederilor Codului Fiscal al Republicii Moldova. Certificatul de rezidenţă emis într-o limbă străină se prezintă cu traducere în limba română, cu excepţia celui emis în limba engleză. Certificatul de rezidență va fi prezentat Cumpărătorului până la prezentarea spre achitare a Invoice-ului.
3. Pentru această procedură de achiziție nu se solicită Garanția pentru ofertă/Garanția de participare, doar garanție de bună execuție 5% din suma Contractului cu TVA.
Documentația de atribuire a fost modificată și va fi publicată pe platforma de achiziții.

Se permite ca denumirea standardelor pe baza carora se va efectua instruirea in limba romana sa fie fara SM? Intrucat nu sunt diferente semnificative fata de versiunea originala ISO a acestora. Denumirea standardelor de pe diplomele emise participantilor poate fi si EN ISO 9001:2015 sau SR EN ISO 9001: 2015 ?

Da, se permite, întrucât SM EN ISO 9001:2015 este identic cu EN ISO 9001:2015.
