Dear All, can a non-resident company submit documents for participation in the tender by providing the resident company with the right to place an offer on the platform through an appropriate Power of Attorney?
If this is allowed, what documents should be additionally provided besides the Power of Attorney? Do these companies then need to form an Association?
Stimati Domni, poate o companie nerezidenta sa depuna documente pentru participarea la licitatie, oferind companiei rezidente dreptul de a plasa o oferta pe platforma printr-o procura corespunzatoare?
Daca acest lucru este permis, ce documente ar trebui furnizate suplimentar in afara de Procura(Imputernicire)? Sau este obligatoriu ca aceste companii sa formeze o asociatie?

Da, o companie nerezidentă poate depune o ofertă dacă corespunde cerințelor de origine stipulate în "Instruction for tenderers". Acordul este necesar în cazul dacă se planifică a realiza contractul în parteneriat specificând clar rolul fiecărui partener. În acest caz se depune și acordul de asociere/consortium semnat de ambele părți.
Yes, a non-resident company can submit a tender if it meets the origin requirements stipulated in the "Instruction for tenderers". The agreement is necessary if it is planned to implement the contract in partnership, clearly specifying the role of each partner. In this case, the association/consortium agreement signed by both parties is also required.
Only authorized platform users may ask questions during the clarification period.
