In conformitatea cu HG 212/2018 privind gestionarea Echipamentelor Electrice si Electronice (EEE) si deseuri ce rezulta din ele (Regulament DEEE): "p.111. .......... instituțiile publice și private care cumpără, primesc prin donație pentru uz propriu EEE vor solicita producătorilor numărul de înregistrare din Lista producătorilor, constituit potrivit prevederilor pct. 45." Reesind din faptul ca in aceasta Licitatie se solicita oferta pentru iclusiv pentru echipament, care cade sub incidenta acestui Regulament, rugam sa ne confirmati despre solicitarea obligatorie a unui astfel de certificat pentru potentialii ofertanti. Bună ziua. La solicitarea DVS, Vă comunicăm următoarele.
În conformitate cu prevederile pct.45 din Regulamentul privind deșeurile de echipamente electrice și electronice, aprobat prin H.G. Nr. 212 din 07.03.2018, publicat în Monitorul Oficial Nr. 95-104 art. 262 din 23.03.2018, ”pentru monitorizarea respectării cerințelor prezentului Regulament, organul central de mediu al administrației publice ține evidența producătorilor de EEE, inlcusiv a celor care furnizează EEE prin intermediul tehnicilor de comunicare la distanță, astfel cum sînt prevăzuți la pct. 7 subpct. 3) lit. d) și, în acest sens, întocmește și menține Lista producătorilor de produse supuse reglementărilor de responsabilitate extinsă a producătorilor (în continuare – Lista producătorilor), prin intermediul unui subsistem informațional parte integrantă a Sistemului informatic automatizat „Managementul deșeurilor” (SIAMD), stabilit conform prevederilor art. 33 alin. (4) lit. c) și art. 12 alin. (5) lit. c) și alin. (6) lit. b) din Legea nr. 209 din 29 iulie 2016 privind deșeurile. Conform pct.52 din același Regulament, începînd cu 1 ianuarie 2019, pot introduce pe piață EEE numai producătorii înregistrați în Lista producătorilor prevăzută la pct. 45.
În context, se subînțelege că vor participa la procedura de achiziții doar companiile care respectă norma citată supra, iar înregistrarea în Lista producătorilor va fi verfiicată prin intermediul datelor deschise publicate pe portalul guvernamental https://siamd.gov.md/portal/deee.html

Cu tot respectul, dar din "p.111. .......... instituțiile publice ș.... vor solicita producătorilor numărul de înregistrare din Lista producătorilor, constituit potrivit prevederilor pct. 45." Nu se va consulta SIAMD, ci se va solicita nr. Faptul ca agentul economic este in Lista Producatorilor pe SIAMD nu poate fi anexat la setul de documente. SIAMD este doar un registru constituit legal si nu un document. Fiecare producator sau distribuitor face dovada ca are un asa numar prin certificat, eliberat de Agentia Nationala de Mediu, nu prin faptul ca se regaseste pe SIA. Dupa analogie-fiecare producator detine certificat de inregistrare, si este pe site-ul Agentiei Servicii Publice, dar oarecum se solicita. Deaceia intrebare - se solicita OBLIGATORIU acest certificat ? Faptul ca asa se subintelege nu este de ajuns.
