In conformitatea cu HG 212/2018 privind gestionarea Echipamentelor Electrice si Electronice (EEE) si deseuri ce rezulta din ele (Regulament DEEE):
"p.111. .......... instituțiile publice și private care cumpără, primesc prin donație pentru uz propriu EEE vor solicita producătorilor numărul de înregistrare din Lista producătorilor, constituit potrivit prevederilor pct. 45."
Reesind din faptul ca in aceasta Licitatie se solicita oferta pentru echipament, care cade sub incidenta acestui Regulament, rugam sa ne informati despre obligatiunea de a detine un astfel de nr. pentru ofertanti.

Buna ziua. Reesind din faptul ca nu ati raspuns la intrebarea referitor la nr.de inregistrare in Lista Producatorilor EEE (p.111 din HG 212/2018), in cazul ca vor fi acceptate ofertele agentilor economici neinregistrati, ne rezervam dreptul de a contesta rezultatele licitatiei.

Nu aveam de gind sa indluentam sau sa intervenim in deciziziile grupului de lucru. Ne bazam doar pe prevederi legale, si anume prevederile obligatorii din p.111 din HG 212/2018 si comunicatul Agentiei Achizitii Publice, si anume:

Prevederile invocate sunt anume pentru a pune in situatie egala toti ofertantii si de a apara/stimula drepturile lor ca companii care suporta cheltueli fata de cei care nu isi indeplinesc obligatiile, impuse prin lege. Statul le-a introdus prin lege si nu grupul de lucru decide sa respecte legea sau nu. A permite oarecui sa participe la licitatie, nerespectind cerintele legale obligatorii nu inseamna a stimula concurenta, inseamna a stimula neglijenta fata de prevederile legale. Ca sa recapitulam - decizia ca grup de lucru va apartine.
